Compliance, environmental liability and due diligence

Whether you have an existing business or property or are in the process of buying one, our team can assist in making sure that you are managing environmental risks and are complying with all your obligations under the Resource Management Act 1991 and associated legislation.

Prosecutions under the Resource Management Act and Heritage New Zealand Pouhere Taonga Act 2014 can leave you with a criminal record, so it’s vital that you have your environmental affairs in order.  Whether you are acquiring, looking to sell, or have an existing business or property, we can assist in making sure you are managing environmental risks and are complying with all your obligations under the Resource Management Act 1991 and associated legislation.

If you are an overseas investor, we can walk you through the acquisition process so that you understand your resource management obligations and risks. We help clients to:
  • ensure compliance with consent conditions;
  • determine what kinds of consents would be required for their proposed developments;
  • deal with complaints, enforcement action and prosecutions;
  • assess and address the risks associated with contaminated land; and
  • ensure compliance with hazardous substances requirements.

Recent experience

Prosecution for unauthorised discharge

Our client was prosecuted by Auckland Council for the accidental discharge of concrete slurry into a stream, causing the contamination of water. We successfully obtained a discharge without conviction.

Due Diligence

Knowing your current and/or future environmental obligations is a critical factor in ensuring you maintain compliance with all resource management requirements. We can provide you with pragmatic advice, tailored for purchasers, vendors and lenders.  Our recent due diligence experience includes work in the following areas:
  • commercial buildings and offices;
  • warehousing;
  • manufacturing;
  • forestry;
  • residential development;
  • subdivision; and
