Construction contract procurement

Inadequate procurement processes and poorly drafted construction contracts can derail any project, leading to added expense, time delays, and litigation.

Kensington Swan’s procurement law experts ensure your investment in these key elements pays dividends in project returns.

We have considerable experience advising on a range of large-scale joint venture projects and complex procurement structures. Our lawyers are familiar with standard form documentation, both in New Zealand and overseas.

We provide procurement law and contract advice to:

  • central and local government
  • consultants
  • contractors
  • developers
  • other public sector bodies.

Recent experience

Claudelands Events Centre

Hamilton City Council’s Claudelands Events Centre was a sensitive and important project for the community, requiring transparency and good value for public money. Kensington Swan advised on procurement methodology and drafted the construction contract, which was awarded to a local contractor, and finished on time.

Northern Motorway Realignment

The Alpurt B2 Northern Motorway Realignment in Auckland (Land Transport NZ/Transit NZ/Kapsch) required conversion of the Design-Build (DB) procurement structure to Design-Build-Operate-Maintain (DBOM) to enable the tolling system to be trialled and managed by the supplier.

Ahuroa Gas Storage Facility

We advised on the joint venture Engineering Procurement Construction (EPC) contract for the Ahuroa Gas Storage Facility near Stratford. This included providing advice on risks and successfully negotiating a preferred position.
